Terms of Use

These Terms of Use ("Terms") govern access to and use of the Captain 37 Quiz Platform (the "Platform"), operated as a multi-organisation quiz and certification service. By creating an account, purchasing a Package, starting a quiz, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Accounts and roles

The Platform supports three kinds of accounts: a platform Superuser who operates the Platform and configures subscription plans, learner Packages, and platform settings; Organisation Admins who create and manage quizzes, pricing, discount codes, and certificates for their own organisation only; and Users (learners) who register once and may take any published quiz across any organisation. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Where an organisation has more than one Admin, adding or removing a colleague's account normally requires that colleague's own approval; approving your own removal (or having a colleague's removal approved) disables that account rather than deleting it, so historical records tied to it are preserved, and the Superuser may reinstate it. If a colleague genuinely cannot access their own account to approve their own removal, the request may instead be escalated directly to the Superuser, with a stated reason, for a direct decision — the outcome is still a reversible account disablement, never a deletion. Where the Superuser has enabled it, a logged-in session that sees no activity for a configured period is automatically signed out (with an on-screen warning first) as a security precaution on shared or unattended devices.

2. Quizzes, pricing, and access

Organisations set their own pricing, pass marks, time limits, and visibility for the quizzes they publish, and may optionally set a start date, an end date, or both, restricting when a new attempt can begin. Outside that window a quiz remains visible and linkable, with the applicable date shown, but a new attempt cannot be started; anyone already partway through an attempt is never interrupted by the window changing or closing, and certificates and leaderboard entries already earned remain valid indefinitely. The Superuser may also require a quiz to have at least a set number of active questions before it can be published, and may cap the maximum number of questions a quiz may hold — either platform-wide, for a specific organisation, or for a specific quiz — and the responsible Organisation Admin is notified in-app whenever one of their quizzes falls short of an applicable minimum. Learner Packages, when offered, are configured by the Superuser and grant access to quizzes for a fixed period of time, as described on the Packages page at the time of purchase. Separately, for a quiz paid for individually, the Superuser sets how many days that paid access is honoured before a new attempt requires paying again — platform-wide by default, though a specific organisation or a specific quiz may be set to a different duration where the Superuser has allowed it; this window is shown on the quiz's "More Info" details before you pay, and where no duration is set, paid access does not expire. This window governs only whether a new attempt is unlocked automatically from an earlier payment — it never affects an attempt already in progress, and a result, certificate, or leaderboard entry already earned remains valid regardless of it. Access to a paid quiz or an active Package does not guarantee a passing score or any particular outcome — it grants the opportunity to attempt the quiz under its stated rules. Discount codes, how many an organisation may hold, and whether an organisation may create them at all, are governed by that organisation's Package and by platform-wide settings, either of which the Superuser may override for a specific organisation. For Corporate Access specifically, the Superuser may adjust an existing corporate batch after it has been set up — for example adding a quiz, changing the seat count or access window, or removing a quiz that no seat has yet been redeemed against — to reflect the agreed arrangement with the purchasing organisation; a quiz with at least one redeemed seat is disabled rather than removed, so results and certificates already earned under it remain valid.

3. Payments and confirmations

Where payment is required, the Platform uses a manual reference-confirmation flow: you submit the payment reference or transaction code you receive from your payment method, and the relevant organisation admin or Superuser reviews and confirms it before access is unlocked. Please retain your payment receipts until access is confirmed. Fees paid for a specific quiz attempt or Package period are generally non-refundable once access has been granted, except where required by law or expressly stated otherwise by the organisation or the Superuser.

4. Certificates and leaderboards

Where a quiz is configured to issue a certificate, a certificate is issued automatically upon a passing score and carries a permanent, publicly verifiable code. Certificates and leaderboard rankings reflect performance on the Platform only and are provided "as is" without any warranty as to their recognition or acceptance by any third party, employer, or institution.

5. Acceptable use

You agree not to: share your account or quiz access with others; attempt to bypass payment, discount-code, or access-password controls; use automated means to scrape questions, answers, or certificates; impersonate another person or organisation; or otherwise misuse the Platform in a way that undermines the integrity of quiz results or certificates.

6. Organisation content

Each organisation is solely responsible for the accuracy, legality, and quality of the quizzes, questions, and descriptions it publishes. The Superuser does not pre-screen organisation content and is not responsible for its accuracy.

7. Participant information

When you take a quiz, the organisation offering it collects the name you enter and, if you provide them, an email address and/or phone number. This information is visible to that organisation's admins (on their Participants page) so they can identify who took their quiz — for example, to contact a prize winner, verify a certificate, or follow up on a corporate batch. It is not shared with other organisations on the Platform, and is not used by the Superuser except for the ordinary running of the Platform (support, fraud prevention, and legal compliance). Providing an email or phone number is always optional unless a specific quiz requires it to unlock certain features (such as a certificate or a WhatsApp-based re-access).

8. Application and request status messages

When an organisation admin submits an application or request that requires review (such as a discount code request, a certificate reissue, or a Consolidated Certificate of Knowledge request), any WhatsApp notification about a decision will direct you to a status page on the Platform rather than stating the outcome or the reason in the message itself. This is a security precaution — it keeps sensitive decision details off of message previews and out of forwarded chats. The full outcome, and the reason if a request was not approved, is always available on the linked status page using the reference code you were given at submission. Some requests — such as a service request an organisation admin raises for the Superuser's attention, selecting the kind of service needed — are instead tracked entirely in-app rather than by WhatsApp: submitting one, and any update to its status, raises a dismissible notification inside the Platform linking to that organisation's own report of its requests, where the full history and any response from the Superuser team is shown. Where the Superuser has left this enabled (it is on by default, and toggleable in Platform Settings), the same kind of in-app notification is also raised for an organisation's admins when the Superuser decides an organisation profile change, certificate pause/resume, certificate branding change, discount code application, or subscription payment that admin submitted.

9. Support messaging

Where enabled, organisation admins may send messages to the Superuser team from within their admin portal. These messages, and any replies, are stored on the Platform and may be reviewed by any member of the Superuser team — this is not a private one-to-one channel between an individual admin and an individual superuser. In-app messaging is a Platform-wide setting the Superuser may turn on or off; while it is off, admins are directed to reach support by email instead.

10. Advertising and promotional content

Quizzes may show full-page promotional cards ("adverts") between questions and on the results screen. An advert may be placed by the organisation offering the quiz, to promote its own other quizzes, courses, or services, or by the Superuser, in which case it may appear across quizzes from multiple organisations. Adverts may include a button or link leading to a page outside the Platform; the Platform is not responsible for the content, accuracy, or practices of any external site reached this way. How often adverts appear is a Platform-wide setting, and some subscription Packages may reduce or remove them.

11. Sponsorships

A quiz may display a sponsor's name and logo on its quiz card, within the quiz itself, and — where the sponsor has opted in — as a co-signature on certificates it issues. A sponsorship may be arranged specifically for a single organisation's quiz, or placed by the Superuser across every organisation's quizzes platform-wide; an Organisation Admin's own Sponsorship Reports page shows both, clearly separated, since the platform-wide ones are not something that organisation configured itself. As with adverts, the Platform is not responsible for the accuracy of sponsor-supplied names, logos, or linked websites.

12. Reporting, search, and data export

Organisation Admins and the Superuser have access to searchable, filterable reports covering participants, certificates, payments, and other quiz activity, scoped to their own organisation (for an Admin) or platform-wide (for the Superuser). These reports can be downloaded as a CSV file, and financial and administrative reports (such as payment records) can also be opened as a formatted, printable page for saving as a PDF via the browser's own print function — for the Admin's or Superuser's own record-keeping, accounting, and compliance purposes. Exported or printed data is subject to the same confidentiality expectations as the on-screen report: it should be handled securely and not shared beyond what is necessary for the purpose it was generated for.

13. Accountability and audit logging

Meaningful actions taken by an Organisation Admin or by the Superuser team — including approvals, rejections, profile and settings changes, payment confirmations, and deletions — are recorded in an internal audit log identifying who took the action and when. This log exists to protect the integrity of the Platform and its users, is reviewable by the Superuser team, and is not affected by any of the data-reset actions described in Section 14 below.

Separately, the platform Superuser account specifically (not a delegated mini-superuser) can clear the audit log outright from the Audit Logs page. This is a distinct, narrower power from the data resets in Section 14 — it is not something a routine reset performs, and is expected to be used sparingly, if ever. Clearing the log does not leave it silent about itself: a fresh entry recording who cleared it, when, and how many entries were removed is written immediately afterwards, so a trace of the clearing action always remains even though the entries it removed do not.

14. Data reset and retention

The Superuser has tools to clear certain accumulated activity data platform-wide or for a single organisation — for example, quiz-taking history, payment records, issued certificates, discount code usage counters, sponsorship impression counts, question-flag reports, and login-attempt records. These reset actions are immediate and cannot be undone once performed. They never delete quizzes, questions, organisations, or user accounts, and they never remove the audit log described above or the historical record of applications and requests (such as organisation applications, discount code requests, or certificate reissue/print requests) — those are retained as a record of who requested and who decided what, unless separately cleared under the Superuser-only audit log power described in Section 13.

15. Data protection and use

This section explains what personal data the Platform collects and how it is used, in addition to the participant-specific points already covered in Section 7 above.

What we collect. Depending on how you use the Platform, this may include: your name, email address, and/or phone number (as an account holder, a quiz-taker, or someone submitting an application, service request, or other request for review); payment references and transaction details you submit for manual confirmation; content you or your organisation create (quizzes, questions, certificates, support messages, service requests and any response to them); and limited technical data such as your IP address and a randomly generated, non-identifying "visitor key" cookie used to recognise a returning quiz-taker (for example, to resume an attempt or check a corporate access code) without requiring an account.

Why we use it. Personal data is used only to operate the Platform: creating and securing accounts, running and scoring quizzes, issuing and verifying certificates, confirming payments, responding to support requests, preventing fraud and abuse (such as rate-limiting login attempts or detecting duplicate discount-code use), and complying with our legal obligations. It is not sold, and it is not used for third-party advertising or marketing outside the Platform.

Who can see it. Access is scoped the same way the rest of the Platform is: an organisation's admins can see data tied to their own organisation's quizzes and activity (as described in Section 7); the Superuser team can see platform-wide data as needed to operate and support the Platform; no organisation can see another organisation's participant data. Where a quiz or advert links to an external website (Section 10) or a message is sent via WhatsApp (Section 8), that step happens outside the Platform and is governed by that third party's own privacy practices, not this policy — nothing you enter into a WhatsApp message or an external site passes through Platform servers.

How long we keep it. Personal data is retained for as long as needed for the purposes above, consistent with Sections 13 and 14: audit log entries and the historical record of applications and requests are kept for accountability and are never affected by a routine data reset (the audit log can only be cleared by the exact Superuser account, as described in Section 13), and a removed account is disabled rather than deleted so that records already tied to it (quizzes, payments, certificates) remain accurate and traceable.

Your choices and rights. Providing an email address or phone number as a quiz-taker is optional unless a specific quiz or feature requires it (Section 7). You may ask the organisation you interacted with, or the Superuser team, about what personal data is held about you, ask for it to be corrected, or ask for your account to be disabled, by contacting the relevant organisation admin or using the details in Section 16. Requests are handled subject to the retention and audit-log exceptions described above — some records (such as a completed certificate, a confirmed payment, or an audit log entry) are kept as a permanent record even after an account is disabled, since removing them would undermine the integrity and verifiability the Platform is built to provide.

Applicable law. The Platform is operated with data protection principles such as those in Zambia's Data Protection Act, 2021 in mind as a baseline. Each organisation using the Platform to collect information from its own quiz-takers is responsible for its own compliance with any data protection or privacy law applicable to it in its own jurisdiction.

16. Changes to these Terms

These Terms may be updated from time to time. Continued use of the Platform after an update constitutes acceptance of the revised Terms. Please also see our Disclaimer.
